Los medios de comunicación social y las decisiones judiciales en el Cercado de Lima, año 2020

Abstract

En noviembre del 2020, el poder ejecutivo estuvo viviendo una situación complicada en vista que habiéndose vacado al Presidente de la República Martín Vizcarra Cornejo; En sólo cinco días, el movimiento ciudadano logró hacer renunciar al recientemente elegido Presidente de la República por el Congreso de la Republica el congresista Manuel Merino; consecuencia de ello, renuncia su premier Antero Flores Araoz, y todo el cuerpo policial que participó en la defensa de la tranquilidad pública por las movilizaciones para vacar al Presidente de la República. Pero, todos estos hechos no hubieran ocurrido si es que la prensa no hubiera azuzado a los jóvenes, quienes no se hubieran movilizado para renunciar al Presidente de la República. Como se puede observar, los jueces y fiscales en vez de actuar con absoluta imparcialidad siguiendo la secuencia de llegada de las denuncias, se encuentran al ritmo de las noticias y el actuar de los medios de comunicación avanzando y retrocediendo de acuerdo al impulso de la prensa tomando decisiones de acuerdo al ritmo de la popularidad dejando de lado el derecho de la neutralidad y la justicia; lo explicado es una evidencia de lo que está ocurriendo desde hace algún tiempo, donde los jueces y fiscales observan el movimiento y el comportamiento de la población por intermedio de los medios de comunicación llegando al extremo de vulnerar el secreto de la información que se encuentran manejando realizando entrevistas en los medios de comunicación brindando detalles del proceso antes de que se logre un resultado final perjudicando el proceso y creando la figura de culpabilidad antes de siquiera haberse iniciado la investigación. Al observar la capacidad mediática de la prensa, la Fiscal de la Nación Zoraida Avalos Rivera se presenta ante la prensa para comunicar la denuncia contra el ex presidente y el ex premier, vulnerando el debido proceso y la presunción de inocencia siendo la cabeza de la Fiscalía de la Nación, promoviendo a que los demás fiscales actúen de la misma manera, habríendo dos tipos de casos: los observados por la prensa que deben ser atendidos con premura y ser sentenciados de acuerdo a la motivación de la población y los que no son observados por la prensa, hechos que pueden quedar sin tratamiento fiscal porque no tienen derechos y no importa si están con prisión preventiva o no.

Observing the media capacity of the press, the National Prosecutor Zoraida Avalos Rivera appears before the press to communicate the complaint against the former president and the former premier, violating due process and the presumption of innocence as the head of the Prosecutor's Office of the Nation, encouraging other prosecutors to act in the same way, there will be two types of cases: those observed by the press that must be dealt with quickly and be sentenced according to the motivation of the population and those that are not observed by the press, facts that can be left without tax treatment because they have no rights and it does not matter if they are in preventive detention or not.
