Sucesión intestada notarial y la afectación del derecho sucesorio de los herederos forzosos

Abstract

El presente trabajo de investigación tiene como objetivo describir y explicar la relación existente entre la sucesión intestada que se tramita por vía notarial y su repercusión en el derecho a heredar de los otros herederos forzosos no incluidos en la declaración de sucesión intestada. La conclusión a la que se ha llegado es que entre la sucesión intestada tramitada por vía notarial y el derecho a suceder de los herederos forzosos existe una relación de causalidad ya que – entre otros factores que se detallará en el desarrollo del presente trabajo – la rigurosidad en las notarías no es óptima lo que suscita que algún heredero forzoso de manera unilateral tramite la sucesión intestadas por vía notarial, a sabiendas que existen otros herederos forzosos, excluyendo a estos del derecho de sucesores y excluyéndolos de la masa hereditaria.

The objective of this research work is to describe and explain the relationship between the intestate succession that is processed by notarial means and its impact on the right to inherit of the other forced heirs not included in the declaration of intestate succession. The conclusion that has been reached is that between the intestate succession processed by notarial means and the right to succeed of the forced heirs there is a causal relationship since - among other factors that will be detailed in the development of this work - the rigor in notaries, it is not optimal what causes some forced heir to unilaterally process the intestate succession through a notary, knowing that there are other forced heirs, excluding them from the right of successors and excluding them from the estate.
