La calificación defectuosa de demandas y su relevancia en el desarrollo y conclusión del proceso civil, Lima-2020

Abstract

Esta investigación tuvo como propósito analizar como la calificación defectuosa de la demanda incide en el desarrollo y conclusión del proceso civil en los Juzgados civiles de primera instancia de la Corte Superior de Justicia de Lima. La metodología aplicada fue la cuantitativa, ya que se utilizan datos numéricos para el analizar la información obtenida. Con relación la tipología investigativa utilizada, es la explicativa, con diseño experimentaltransversal. Como población de la investigación se consideraron 40 personas adscritas a los Juzgados Civiles de la Corte Superior de Justicia de Lima, de igual manera estas personas conformaron la muestra por ser una población pequeña y de fácil acceso. Para recogerla información se usó la encuesta como técnica, y un cuestionario como instrumento con 23 ítems. Se obtuvo como conclusiones que la calificación defectuosa de la demanda incide en el desarrollo y conclusión del proceso civil en los Juzgados civiles de primera instancia de la Corte Superior de Justicia de Lima, se obtuvo un p(valor) equivalente a 0.0001, menor que 0.05 por lo que se rechaza la hipótesis nula y se acepta la alterna: La calificación defectuosa de la demanda incide en el desarrollo y conclusión del proceso civil en los Juzgados civiles de primera instancia de la Corte Superior de Justicia de Lima.

The purpose of this investigation was to analyze how the faulty qualification of the claim affects the development and conclusion of the civil process in the civil courts of first instance of the Superior Court of Justice of Lima. The applied methodology was quantitative, since numerical data are used to analyze the information obtained. Regarding the investigative typology used, it is the explanatory one, with a cross-sectional experimental design. As a population of the investigation, 40 people assigned to the Civil Courts of the Superior Court of Justice of Lima were considered; in the same way, these people made up the sample because it was a small and easily accessible population. To collect the information, the survey was used as a technique, and a questionnaire as an instrument with 23 items. It was obtained as conclusions that the defective qualification of the claim affects the development and conclusion of the civil process in the civil Courts of first instance of the Superior Court of Justice of Lima, a p (value) equivalent to 0.0001 was obtained, less than 0.05 Therefore, the null hypothesis is rejected and the alternative is accepted: The defective qualification of the claim affects the development and conclusion of the civil process in the civil courts of first instance of the Superior Court of Justice of Lima.
