La discriminación de varones víctimas de violencia de género en el Perú, por parte de la Ley N° 30364, vigente al 2019

Abstract

La violencia de género continua siendo una de las manifestaciones más claras de la desigualdad, subordinación y de las relaciones de poder de los varones sobre las mujeres, sin embargo en ocasiones los varones también son víctimas de violencia, el maltrato a los varones se considera un tabú debido que se mantiene una cultura machista donde el elemento común es que él sea quien grite y golpee a la mujer, siendo esta la causa fundamental por la que los casos de violencia hacia el varón no son denunciados debido a que, no saben qué hacer ni donde recurrir, hecho que demuestra la clara desventaja que tiene el varón maltratado, desde el punto de vista jurídico. Estos tipos de violencias se fundamentan y se ejercen por la diferencia subjetiva entre los sexos, el cual quiere decir que las mujeres sufren violencia por el mero hecho de ser mujeres, siendo víctimas de cualquier estrato social, nivel educativo, cultural o económicas. La finalidad del agresor es causar daño y conseguir el control sobre el opuesto. El trabajo en desarrollo tiene como propósito y objetivo fundamental realizar indagar sobre los aspectos más relevantes de la violencia de género, analizando la situación de la víctima de la violencia de género, desde la perspectiva de la discriminación como factor determinado por el derecho y la ley. Como ya se mencionó antes, la violencia de género es aquella que se ejerce principalmente sobre las mujeres por parte de quienes estén ligados a ellas por relaciones de afectividad. Para poder hacer un análisis de esta temática se plantearon una serie de objetivos que paulatinamente sirvieron de guía para el desarrollo de la propuesta final. Seguidamente se estableció la teoría que abarca la temática de violencia de género y seguidamente el marco legal allí descrito, posterior a ello se realizaron procedimientos metodológicos que en base a diferentes técnicas e instrumentos de recolección de información permitieron dar con los resultados finales del estudio.

These types of violence are based and are exercised by the subjective difference between the sexes, which means that women suffer violence by the mere fact of being women, being victims of any social stratum, educational level, cultural or economic. The purpose of the aggressor is to cause damage and gain control over the opposite. The work in development has as its purpose and fundamental objective to investigate the most relevant aspects of gender violence, analyzing the situation of the victim of gender violence, from the perspective of discrimination as a factor determined by law, And the law. As already mentioned before, gender violence is that which is exercised mainly over women by those who are linked to them by relationships of affectivity. In order to make an analysis of this topic, a series of objectives were proposed that gradually served as a guide for the development of the final proposal. Then the theory that covers the subject of gender violence was established and then the legal framework described there, after that methodological procedures were carried out that based on different techniques and information collection instruments allowed to find the final results of the study.
